The Commercial Dispute

The client provides an open banking platform that seamlessly links their customers and respective clients and end-users to over 2,000 banks and institutions across 19 different countries. The debtor entered into an agreement with the client for access to their platform and services, committing to an agreed monthly fee.

Although the debtor did not dispute the client’s services, they contended that the costs were disproportionate to the level of usage, despite the contractual terms agreed from the outset, which were not linked to the volume of customer traffic or transactions.

How Escalate Resolved – Services Used

Escalate contacted the debtor, who initially tried to argue the position but quickly accepted that it was untenable. They conceded that the real reason for non-payment was ongoing cash flow constraints. 

Under the threat of further action if left unresolved, the parties reached a settlement agreement that ensured the client received the full outstanding amount, while enabling the debtor to continue trading unaffected. Escalate also played a key role in securing a cross-company guarantee with the debtor’s parent company in the United Arab Emirates, providing an additional layer of security in the event of non-payment.
