The Commercial Dispute

Our client’s heavy goods vehicle was damaged by a fire, following on from a mechanical breakdown.

They made a claim on their HGV’s insurance policy, however the Defendant’s insurer refused to cover the costs of replacing the vehicle. The insurers disputed that the policy covered mechanical breakdown, and also asserted that the claimant had failed to take reasonable steps to protect their vehicle.

How Escalate Resolved – Services Used

Once Escalate had engaged this case in April 2019, we entered into pre-action correspondence with the insurer’s representative, but they were unwilling to reconsider their position.

We issued proceedings and progressed the matter through to the disclosure stage of the proceedings. A Joint Expert report found in favour of our client, and accordingly the matter was settled under a Consent Order for the full pleaded claim, as well as Escalate’s costs.

From start to finish, the case was resolved less than 12 months from initial engagement.
